Cansly --- Buyer Policy
This Buyer Policy forms an integral part of the Cansly Terms of Service and is incorporated therein by reference. By accessing, using, or purchasing through the Platform, Buyers expressly acknowledge and agree to be bound by this Buyer Policy, the Terms of Service, the Refund Policy, the Privacy & Cookie Policy, and the Prohibited Items & Services Policy, each of which is incorporated into this Policy in full. It is agreed and understood that agreements formed on Cansly shall be regarded as contract under Contract Act, 1872 and as such, Vendors and Buyers will have to discharge their responsibilities towards each other and Cansly in compliance with section 37 of Contract Act, 1872.
Without limitation, Buyers expressly agree that the following provisions of the Terms of Service apply to all transactions, claims, disputes, and interactions arising from or relating to the Platform, Vendors, Products, or Services:

Mandatory internal dispute resolution procedures;

Binding arbitration requirements;
-
Class-action waiver;
-
Disclaimers of warranties and representations;
-
Limitations and exclusions of liability;
-
Indemnification obligations;
-
Releases of claims;
-
Covenant not to sue;
-
Anti-chargeback covenant and related obligations; and
-
The applicable six (6) month contractual limitation period for bringing claims.
1. Marketplace Status and Buyer Assumption of Risk
Cansly operates solely as an intermediary marketplace platform that facilitates connections between Buyers and Vendors. Cansly is not the seller, supplier, manufacturer, distributor, importer, exporter, reseller, or owner of any Product or Service offered through the Platform unless expressly stated otherwise. All agreements formed shall be strictly between Buyers and Vendors with no liability on Cansly apart from Cansly's right to platform fee and enforce compliance with the terms that Cansly stipulates to form an agreement. As such any act or omission of either Buyer or Vendor causing any damage or loss to Cansly will entitle Cansly to seek full indemnification.
All contracts of sale, purchases, transactions, representations, warranties, obligations, and disputes relating to any Product or Service are exclusively between the Buyer and the applicable Vendor. The Vendor, and not Cansly, is solely responsible for the listing, sale, delivery, quality, legality, safety, authenticity, performance, and compliance of any Product or Service.
By engaging in any transaction through the Platform, Buyers acknowledge and accept that they transact directly with Vendors and assume all risks associated with evaluating, selecting, purchasing, receiving, using, or relying upon any Product, Service, Vendor, listing, representation, or transaction facilitated through the Platform.
2. Buyer eligibility and account registration
2.1 Eligibility, Registration, and Identity Verification
To purchase, transact, or otherwise use the Platform as a Buyer, you must be at least eighteen (18) years of age, possess full legal capacity to enter into binding contracts under applicable law, and successfully register and maintain a valid Account. As part of the registration and verification process, you must provide complete, accurate, current, and verifiable information, including, where requested by Cansly, your full legal name, National Identification Document (NID) number, passport number, date of birth, mobile phone number, email address, residential or business address, payment information, and any additional information or documentation required for identity verification, compliance, fraud prevention, risk assessment, regulatory obligations, or Platform security.
You represent and warrant that all information submitted to Cansly is true, accurate, complete, current, lawfully obtained, and belongs to you. You shall promptly update any information that becomes inaccurate, outdated, incomplete, or misleading. Cansly reserves the right, at any time and without liability, to request additional information, documentation, verification procedures, biometric verification, identity confirmation, proof of address, proof of ownership of payment instruments, or any other information reasonably required to verify your identity, assess risk, comply with legal obligations, or protect the Platform and its Users.
Failure to provide requested information, failure to successfully complete verification procedures, or the provision of inaccurate, misleading, incomplete, or unverifiable information may result in the rejection of registration, suspension of account privileges, transaction restrictions, withholding of Platform services, cancellation of transactions, account termination, reporting to relevant authorities, or any combination thereof.
2.2 Account Security, Monitoring, and Risk Controls
You are solely responsible for maintaining the confidentiality, security, and integrity of your Account credentials, devices, authentication methods, and all activities conducted through or associated with your Account, whether authorized by you or not. You shall immediately notify Cansly of any actual or suspected unauthorized access, credential compromise, security breach, identity theft, unauthorized transaction, or misuse of your Account. Cansly shall not be liable for any loss, damage, unauthorized activity, or transaction resulting from your failure to secure your Account or promptly report a security incident.
To protect the Platform, its Users, and its operations, Cansly may collect, process, analyze, and retain device fingerprints, IP addresses, browser data, operating system information, device identifiers, network information, geolocation data, behavioral indicators, account associations, contact information stored on devices (subject to applicable permissions and law), transaction history, login patterns, risk signals, and other technical or operational data for fraud prevention, account security, compliance, investigations, risk management, and enforcement purposes.
Cansly may, in its sole discretion and without prior notice, link related Accounts, flag suspicious activity, conduct investigations, require enhanced verification, impose transaction limits, delay withdrawals or payments, restrict functionality, suspend access, refuse transactions, terminate Accounts, preserve evidence, cooperate with law enforcement agencies, or take any other action reasonably necessary to prevent fraud, abuse, circumvention of Platform rules, unauthorized activities, or legal violations. Cansly's monitoring, security measures, and fraud prevention systems are provided for Platform protection purposes only and do not constitute a guarantee against fraud, unauthorized access, identity theft, or security incidents.
2.3 Single Account Requirement; Anti-Evasion and Enforcement
Unless expressly authorized in writing by Cansly, each natural person may maintain only one (1) Buyer Account on the Platform. The creation, control, operation, acquisition, transfer, use, or attempted use of multiple Accounts by the same individual, household, entity, device group, payment method, or related party for the purpose of obtaining unauthorized benefits, circumventing restrictions, avoiding verification requirements, evading penalties, manipulating promotions, interfering with Platform operations, concealing identity, engaging in fraud, or otherwise bypassing Platform rules constitutes a material breach of this Policy.
Cansly may determine, in its sole discretion, whether multiple Accounts are related through technical, operational, behavioral, financial, geographical, ownership, device, network, or other risk indicators. Where Cansly reasonably suspects multi-accounting, account farming, identity manipulation, ban evasion, policy circumvention, collusion, fraudulent conduct, or other prohibited activities, Cansly may, without prior notice and without liability, merge or link Accounts, invalidate promotional benefits, cancel transactions, withhold refunds, reverse credits, restrict Account functionality, suspend or terminate one or more Accounts, retain records for investigative purposes, recover losses, and pursue any legal or equitable remedies available.
Cansly further reserves the right to disclose relevant information and cooperate with law enforcement agencies, regulatory authorities, courts, payment processors, financial institutions, or other competent governmental bodies in connection with suspected unlawful conduct, fraud, cybercrime, identity misuse, money laundering, sanctions violations, or other violations of applicable law.
2.4 Prohibited, False, Fraudulent, and Unauthorized Accounts
Any Account containing, associated with, or created using fictitious, false, inaccurate, forged, altered, misleading, incomplete, stolen, unauthorized, compromised, unverifiable, or otherwise invalid information shall constitute a violation of this Policy and the Terms of Service.
Without limiting the foregoing, Accounts created or operated using another person's identity, fabricated credentials, temporary or disposable contact information, unauthorized payment methods, fraudulent documentation, synthetic identities, impersonation, deceptive information, or information obtained without lawful authorization are strictly prohibited. Cansly reserves the right, at its sole discretion and without liability, to investigate, review, verify, monitor, restrict, suspend, terminate, refuse registration of, or permanently ban any Account where it reasonably believes that:

The Account contains false, misleading, inaccurate, or unverifiable information;

The identity of the Account holder cannot be adequately verified;
-
The Account has been created, accessed, or used for fraudulent, unlawful, deceptive, abusive, unauthorized, or prohibited purposes;
-
The Account presents a security, legal, operational, financial, reputational, or compliance risk to Cansly, the Platform, Vendors, Buyers, payment providers, or other Users;
-
The Account is associated with policy circumvention, ban evasion, multi-accounting, identity manipulation, payment fraud, chargeback abuse, money laundering, sanctions violations, or other suspicious activities; or
-
Continued access to the Platform may expose Cansly or its Users to actual or potential harm, liability, loss, investigation, or regulatory action.
Cansly may treat any Account as unverified, restricted, or ineligible for transactions until all requested verification procedures have been successfully completed to Cansly's satisfaction. Cansly shall have no obligation to approve, maintain, reactivate, or restore any Account that fails verification requirements or otherwise presents an unacceptable risk. Where fraud, abuse, unauthorized activity, or policy violations are suspected, Cansly may preserve, collect, review, and retain relevant records, communications, transaction data, device information, network identifiers, payment information, access logs, and other evidence for investigative, security, compliance, legal, regulatory, or enforcement purposes, including after suspension or termination of the Account.
Cansly may also restrict, suspend, terminate, or permanently prohibit access by any related Account, device, browser, network, payment instrument, payment account, phone number, email address, identity document, or other identifier reasonably believed to be associated with the prohibited conduct. Termination, suspension, restriction, investigation, or refusal of service under this Section may occur with or without prior notice and without any obligation on the part of Cansly to disclose the basis of its decision where such disclosure could compromise security, investigations, fraud prevention measures, legal compliance, proprietary systems, or the safety of the Platform and its Users.
Nothing in this Policy shall limit Cansly's right to report suspected misconduct to law enforcement agencies, regulatory authorities, payment processors, financial institutions, governmental bodies, or other relevant third parties, or to pursue any legal, equitable, contractual, or administrative remedies available under applicable law or the Terms of Service.
3. Buyer responsibilities and conduct
3.1 Buyer Obligations
You agree to use the Platform lawfully and in good faith, provide accurate and complete information, make all payments through the Platform, conduct transactions only on the Platform, and comply with the Terms of Service and all applicable Policies.
3.2 Prohibited Conduct
You must not:

Conduct or attempt transactions or payments outside the Platform;

Share or solicit contact or payment details to circumvent the Platform;
-
Abuse the dispute, refund, review, or buyer protection systems;
-
Use bots, automated tools, false identities, or multiple Accounts in violation of Platform rules;
-
Circumvent security, verification, fraud prevention, or geographic restrictions; or
-
Harass, threaten, or abuse Vendors, Users, or Cansly personnel.
Cansly shall not be responsible or liable for any off-Platform transaction, payment, communication, or arrangement.
3.3 Vendor Relationship and Assumption of Risk
You acknowledge that Products and Services are offered by independent Vendors and that your purchase contract is solely with the applicable Vendor. Purchases are made at your own risk, and Cansly does not guarantee, warrant, or assume responsibility for any Vendor, Product, Service, code, key, account, or transaction.
To the fullest extent, you release the Cansly Parties from claims arising from Vendors, Products, Services, transactions, or the acts or omissions of other Users, as further provided in the Terms of Service.
4. Placing of orders and payment
4.1 You place an Order by selecting a Product and any applicable variant, completing required custom fields, reviewing the order summary (including the Product price, Platform Fee, and total amount payable), accepting the Terms and applicable Policies, and successfully completing payment.
4.2 Payments are processed at checkout through Cansly's designated payment service providers, including Moneybag for supported local payment methods and authorized international payment service providers where applicable.
4.4 Each Order includes a 2.5% Buyer Platform Fee. The Platform Fee is non-refundable except where expressly provided in the Refund Policy.
4.5 You are responsible for ensuring that all selected Products, variants, quantities, delivery details, and custom-field information are accurate before placing an Order. Refunds will not be granted for errors caused by your own selections or submitted information.

In the event that any advance payment is made for a Product that is not immediately available, whether through debit card, credit card, bank transfer, mobile financial services, or any other payment method, and the Vendor fails to deliver the Product within 5 (Five) Business Days for any reason whatsoever, the Buyer shall be entitled to a full refund of the amount paid. Such refund shall be processed through the same payment method used by the Buyer and shall be completed within a maximum of 10 (Ten) days, excluding any processing time required by the relevant payment service provider. Any charges associated with such refund shall be borne by the Vendor, as applicable. The Buyer shall be notified of the refund through email, SMS, telephone, or any other mode of communication deemed appropriate by Cansly. This provision shall apply provided that the failure to receive the Product is not attributable to any act, omission, or fault of the Buyer.

The Buyer acknowledges and agrees that Cansly may maintain and retain records relating to Orders' transactions, payment details, and other relevant information associated with the Buyer's transaction on the Platform for a period of up to 6 (Six) years, or for such longer period as may be required under applicable law, regulatory requirements, court order, or the directions of any competent governmental authority. Such records may be disclosed to law enforcement agencies, regulatory authorities, courts, tribunals, or other competent authorities where required by law or where Cansly reasonably considers such disclosure necessary for compliance, investigation, fraud prevention, dispute resolution, or the protection of its legal rights and interests.
5. Receiving & Confirming Delivery

Digital Products are usually delivered automatically and instantly after payment confirmation and fraud-gate clearance, shown on the Order Detail page and emailed (and optionally by SMS). Some Products are delivered manually in physical forms. In such cases, delivery shall be completed within 5 (Five) Business Days for deliveries within Dhaka, Bangladesh, and within 10 (Ten) Business Days for deliveries to any other location within Bangladesh. For international deliveries, delivery timelines shall be subject to the schedules and performance of the relevant courier or logistics service providers, including but not limited to FedEx and DHL. Cansly shall not be liable for any delay attributable solely to such third-party delivery service providers.

For Products requiring manual delivery, Cansly shall ensure that the Product is handed over to the relevant delivery service provider within 48 (Forty-Eight) hours of receiving full payment from the Buyer and shall notify the Buyer of the same through email, SMS, telephone, or any other mode of communication deemed appropriate by Cansly.

You must promptly inspect and verify any delivered Product upon receipt. In any dispute, claim, or investigation relating to delivery, the Cansly delivery records, including delivery timestamps, delivery channel information, and masked code or credential previews, shall constitute primary and highly persuasive evidence of delivery and fulfillment.

High-risk Orders may be briefly held for manual review before release. The following shall be regarded as high-risk orders:
a. New account's first order regardless of category, especially when a brand-new buyer places a large first order.
b. Rapid repeat orders where the same buyer places multiple high-value orders within a short period (minutes or hours), particularly for identical products.
c. Orders where the buyer's location, IP address, or payment origin does not match the ordered product or expected purchasing pattern.
d. Bulk orders of the same item, purchasing many units of a single product in one transaction, which is common in card-testing fraud.
e. Orders with mismatched billing or account details, such as name mismatches or inconsistent KYC information for high-value buyers
- In the event that an Order cannot be fulfilled due to circumstances beyond the reasonable control of Cansly or the Vendor, Cansly shall notify the Buyer of such inability within 48 (Forty-Eight) hours of becoming aware of the same. Any payment received in respect of such Order shall be refunded to the Buyer within 72 (Seventy-Two) hours, excluding any processing time required by the relevant payment service provider.
5. The 24-Hour Confirmation Window

On delivery you have a 24-hour Buyer-Protection Window to confirm or dispute. This is the only window in which you can dispute.

If you confirm that the Order is fit for purpose, the Order completes immediately. If you do nothing, it auto-completes on expiry, funds release to the Vendor, and the Order is final (except where Cansly opens a dispute for detected fraud).

Do not confirm until you have verified the Product works. Once you confirm, or the Window expires without a dispute, you generally lose any refund right.
6.4 Where a complaint is submitted by a Buyer, Cansly shall duly record the complaint and, within 72 (Seventy-Two) hours of receipt thereof, communicate to the Buyer the steps taken, or proposed to be taken, in relation to the resolution of such complaint.
6. Opening & Managing Disputes

You may open a dispute from the Order Details page within the applicable Dispute Window by selecting the dispute category, describing the issue, and submitting any supporting evidence. Upon submission, a dispute ticket will be created and the disputed funds may be placed on hold pending resolution.

All dispute-related communications must be conducted through the dispute chat system. You must provide accurate, complete, and timely information and evidence. Failure to cooperate or provide requested evidence may adversely affect your claim.

Cansly may participate in the dispute process, request additional information from either party, and review all available evidence. Subject to the Terms of Service and applicable law, Cansly's determination shall be final and binding on the parties.
7. Dispute-Resolution Policy

Valid reasons: invalid/used code; wrong product/region; item not received though marked delivered; seller fraud; payment issues (e.g. double charge).

Outcomes: Full Refund, Partial Refund, Replacement, Force Complete (Vendor wins), or No Action. Financial effects are governed by the Refund Policy.

Targets: initial review ~2 (Two) hours; Vendor response within 24 (Twenty-Four) hours; communicating the buyer within 72 (Seventy-Two) hours of the steps taken or proposed steps to be taken, and reaching any resolution generally within 48 (Forty-Eight) hours of such communication. Cansly Plus Buyers receive priority handling.

Where both sides' evidence is insufficient, Cansly defaults to a 50/50 partial-refund outcome. Insufficient evidence shall be deemed to mean where neither party has submitted evidence meeting the Strong or High rating as mentioned under the Evidence Standards for Disputes and where both parties have only provided Medium or Low-tier evidence (e.g., screenshots without sufficient context or unsupported statements). However, if one party provides Strong or High-tier evidence while the other does not, the dispute will be resolved in favor of the party with the stronger evidence, and the 50/50 default will not apply.
Evidence Standards for Disputes
In assessing a dispute, Cansly may consider all relevant information and evidence submitted by the Parties. The following table sets out the indicative evidentiary value generally assigned to different categories of evidence:

Cansly reserves the right to determine the relevance, authenticity, reliability, and evidentiary value of any material submitted in connection with a dispute. Cropped, altered, blurred, manipulated, incomplete, or undated screenshots, recordings, or documents may be assigned reduced evidentiary value or disregarded entirely where their authenticity or reliability cannot reasonably be verified.
9. Anti-Abuse Rules
The following are violations with escalating consequences (warning → flag → suspension → permanent ban):
a) False disputes (claiming a valid code is invalid where the Vendor proves validity);
b) Code-use-then-dispute (using/redeeming then disputing --- permanent ban on discovery);
c) Chargebacks without disputing first (immediate suspension; Cansly contests the chargeback and recovers the disputed amount, fees, and its handling, collection and legal costs on an indemnity basis);
d) Repeated unfounded disputes;
e) coordinated or fraudulent refund/dispute schemes.
- Cansly may withhold or reverse abusive refunds, recover Losses, forfeit relevant Vendor Balance, retain evidence, and report serious cases to authorities and/or take legal action.
10. Messaging Conduct (Open, Monitored, No Off-Platform Deals)
- On-Platform messaging is available before, during and (limitedly) after an Order. All messages exchanged through the Platform may be monitored, filtered, reviewed, and logged by Cansly for the purposes of fraud prevention, security, quality assurance, dispute resolution, compliance with applicable laws, and the detection and prevention of scams, prohibited activities, or other unlawful conduct. By using the messaging system, Users acknowledge and consent to such monitoring and understand that messages exchanged through the Platform may be retained and used as evidence in connection with disputes, investigations, or legal proceedings.
You must not share, request, or exchange phone numbers, email addresses, social media accounts, external links, payment details, or any other contact information for the purpose of conducting transactions outside the Platform. You must not arrange off-Platform transactions or participate in any scheme intended to bypass the Platform, including "cancel and repurchase" arrangements. Cansly may use automated systems to detect and restrict such conduct and may impose enforcement measures, including content blocking, warnings, messaging restrictions, account limitations, suspension, or termination.
- Any transaction, payment, communication, or arrangement conducted outside the Platform is undertaken entirely at your own risk. Buyer Protection, dispute resolution, and related Platform safeguards do not apply to off-Platform transactions, and Cansly shall have no responsibility or liability arising from them.
11. Reviews and ratings rules

You may leave one review per completed Order, genuine, lawful and based on your actual experience.

You must not post false, defamatory, abusive, infringing or manipulated reviews, use reviews to extort Vendors, or trade reviews for incentives. Cansly may moderate, edit, refuse or remove reviews and act against manipulation.
12. Consumer-Protection Compliance

Cansly operates consistently with the Consumer Rights Protection Act, 2009 and the Digital Commerce Operation Guidelines, 2021. The buyer-protection mechanism, dispute system and failed-delivery auto-refund are how Cansly delivers consumer protection for digital Products.

Nothing in this Policy removes a non-excludable statutory consumer right. Where this Policy and a non-excludable right conflict, the right prevails to the extent required by law, and the remainder of this Policy continues to apply to the maximum extent permitted
13. Buyer account suspension grounds
Cansly may, in its sole discretion and with or without prior notice, restrict, suspend, or terminate a Buyer Account for any violation of the Terms of Service or applicable Policies, including fraud or suspected fraud, abuse of disputes, refunds or chargebacks, messaging violations, multi-accounting, ban evasion, circumvention of fees, payment systems or geographic restrictions, or any conduct that may harm the Platform, Vendors, Users, or Cansly's operations.
Cansly may impose temporary purchasing or account restrictions, typically for a period of 30 to 90 days, where it determines that additional risk controls or enforcement measures are appropriate. Any such restrictions may be documented and communicated to the affected Buyer.
14. Prohibited buyer activities
You must not engage in any activity that violates the Terms, applicable Policies, or applicable law, including:

Conducting or attempting transactions or payments outside the Platform;

Sharing, requesting, or soliciting contact information or payment details to circumvent the Platform;

Abusing or manipulating the dispute, refund, review, buyer protection, or chargeback processes;
-
Using bots, scrapers, automated tools, false identities, or multiple Accounts;
-
Circumventing geographic restrictions, security measures, verification requirements, or fraud prevention controls;
-
Purchasing, selling, or facilitating prohibited items or services;
-
Harassing, threatening, or abusing Vendors, Users, or Cansly personnel; or
-
Engaging in any unlawful, fraudulent, deceptive, or prohibited activity, including money laundering, payment fraud, or other criminal conduct.
Consequences may include order cancellation, holds, refusal of refunds, suspension, permanent ban, recovery of losses and costs, and referral to authorities.
15. Complaint & Escalation Process (Internal → DNCRP)
Step 1 --- Internal. Raise the issue through the on-Platform dispute system (within the Window) or contact Support at support@cansly.net/ +880 1601-400668.Step 2 --- Escalation within Cansly. If unresolved, request escalation to senior operations, or write to legal@cansly.net. In this regard, please refer to Section 20 of the Terms and Conditions. (s).
Step 3 --- DNCRP / authority. If still unresolved, Buyer may exercise any non-excludable statutory right, including escalation to the Directorate of National Consumer Rights Protection (DNCRP) or other competent authority in Bangladesh. Other disputes are subject to the arbitration and forum provisions in Section 19 of the Terms.
